Terms and Conditions

This agreement is between Robert Littlejohns (hereafter referred to as “the Photographer”) and the Client for a Pet Photography Session (hereafter referred to as “the Session”). This agreement must be read alongside correspondence where the following details will be agreed:

  • Location of the Session
  • Date and time of the Session
  • Duration of the Session
  • Pets to be photographed during the Session
  • Price of the Session

Description of Services

A Pet Photography Session is a pre-agreed time during which the Photographer will capture photographs of the pre-agreed pets. After the Session, the Photographer will process any photographs taken. Those that are of acceptable quality to the Photographer will be provided to the Client for download using an online gallery. Professional prints can also be purchased at an additional charge.

Payment Terms

Payment for goods and services are made in advance by credit/debit card using a payment link or an invoice on the Stripe platform. Request for payment will be provided by email when payment is due (either on agreement of Session details, or after a request for prints or further digital photographs). Alternatively, payment can be taken by card in person if required. Cash and cheques are not accepted for payment.

The Session is not confirmed until payment is made and must be made more than 48 hours before the agreed Session start time. If payment is not made by this point, the Photographer reserves the right to cancel the booking.

The Photographer is not VAT registered so VAT is not charged on goods or services.

Copyright and Ownership

The copyright and ownership of all images captured by the Photographer will remain that of the Photographer. The Client is granted a non-commercial, non-exclusive licence for digital photographs purchased. This licence permits the sharing of digital photographs on social media websites with friends and family and creation of prints for personal use. The Client may not resell images. Any usage beyond this must be agreed in writing with the Photographer.

The Photographer reserves the right to use any photographs captured for publicity or advertising purposes without providing compensation to the Client.

Duties of Client

The Client will obtain all permissions necessary for the Photographer to photograph at the agreed location. The Client understands and agrees that any failure to obtain these permissions which result in fines to the Photographer or prevents the Photographer from photographing during the session is not the fault, liability, or responsibility of the Photographer. Any fine, penalty, or charge incurred by the Photographer shall be paid for by the Client.

The Client must be able to provide reasonable control of their pet. The pet must not risk causing harm to the Photographer or to the public during the Session. The Client must let the photographer know in advance of the Session if their pet has shown negative reactive behaviour (including but not limited to growling and biting) towards men. If the Photographer reasonably believes that harm may arise from the pet, they reserve the right to cancel the Session without refund.

Multiple Pets

Where multiple pets are to be photographed during the Session, it cannot be guaranteed that all pets will be photographed equally, or at all, during the Session. The Photographer will make best efforts to ensure all pets are photographed but a longer session time may be required for large numbers of pets.

Artistic License

The Photographer is granted full artistic license when capturing photographs during a Session. The Client accepts that factors outside of the Photographer’s control such as weather, location, and behaviour of the pet will impact the photographs taken during a Session.

If the Client has any specific requests for the Session, then they must make them clear before, or at the start, of the Session and the Photographer will do their best to achieve them but the Client accepts that this may not be possible in all situations due to factors including weather, location, available equipment.

Cancellation Policy

The Client may cancel a Session up to 48 hours in advance of the Session start time and receive a full refund. If the Client cancels a Session less than 48 hours in advance of the Session start time, then they will receive a 50% refund of the Session cost.

The Photographer may cancel a Session up to 48 hours in advance of the Session start time and will offer a full refund or an opportunity to reschedule at no further cost. There may be circumstances where the Photographer must cancel a Session less than 48 hours in advance of the Session start time, either due to illness, injury, equipment damage, or poor weather. These will be avoided wherever possible, but in this event the Photographer will offer a full refund or an opportunity to reschedule at no further cost.

Limit of Liability

In the unlikely event that a Session cannot take place due to reasons such as illness, injury, equipment damage/loss, act of God, government restriction, or other cause, the liability of one party to the other shall be limited to the agreed price of the Session.
